Renting in Georgia: Lease Contract, Deposit and Risks
The law will protect you... but only if you know how it works! ⚖️
💡 Even in hospitable Georgia, not knowing the legal nuances of renting can lead to unpleasant surprises: a lost deposit, sudden eviction, or disputed payments. We explain in simple words how the law can protect a tenant and what’s important to know before you sign a contract — or agree to rent “by word of mouth.” 😉
Mandatory legal points when renting housing:

📝 Is a written contract required by law?
In Georgia, a written rental agreement is not legally required for short-term or household rentals. But! Without it, you have no evidence of the terms of the agreement. Even a simple receipt or correspondence already plays the role of a document. It’s better to always have at least some written trace of your arrangements.
⚖️ When does a contract have legal force?
A rental agreement is considered valid if:
- It states the parties (full name, passport details).
- It specifies the main terms: the rental property, the term, the amount, the payment procedure.
- It has signatures of both parties.
Notarization is not required in most cases — a simple written form is sufficient.
🔐 How to record rental terms if there is no contract?
If the landlord insists on renting “as friends,” use these protection methods:
- Ask for a receipt confirming the money received and the rental terms.
- Keep messenger correspondence confirming all agreements.
- Take photos or scans of key documents.
- Transfer money cashless with the note “rent.”
These simple steps can save you if a dispute arises.
When do you need a notary or a contract translation?
In most cases, a notary is not required when renting housing in Georgia. A simple written contract with signatures of both parties is enough. Notarization is needed only in certain situations: if you plan to use the contract to arrange a residence permit (ВНЖ), registration at the place of residence, or if you заключаете a long-term lease with special conditions.
As for translation — by law, the contract may be drafted only in the Georgian language 🇬🇪. But for your safety, it’s important to understand what you are signing. If the landlord provides the contract only in Georgian, ask for a bilingual version or make an unofficial translation of the key points. This will help avoid misunderstandings and unpleasant “surprises.”
💡 Do not sign documents you do not understand — it’s better to spend time on translation than money on solving problems.
⚖️ What laws and articles protect a tenant in Georgia?
Rental relations in Georgia are regulated by the Civil Code of Georgia (საქართველოს სამოქალაქო კოდექსი). This document defines the rights and obligations of both the tenant and the landlord.
Key points protected by the legislation:
- 📜 The procedure for concluding and terminating a lease agreement
(Articles 531–538 of the Civil Code of Georgia) - 💸 Rights to receive and return a deposit
(Article 537 — Tenant’s rights at the end of the agreement) - 🏠 Liability of the parties for the safety of property
(Articles 535–536 — Obligations of the landlord and the tenant) - ⚖️ Protection from unjustified rent increases or sudden eviction
(Article 533 — Conditions for changing the agreement)
💡 Important: The law works only when you have written confirmations of your agreements. Without a contract or receipt, it will be difficult to defend your rights, even with reference to the law.
